Welcome to Kite Mavericks, a platform connecting kitesurfing instructors with students. Before using our service, please read and agree to the following terms and conditions:
1. Acceptance of Risk: Kitesurfing is an extreme and inherently dangerous sport that involves risks, including but not limited to injury, damage to property or equipment, and even death. By using our service, you acknowledge and accept these risks and agree that you are solely responsible for your safety and any consequences that may arise from your use of our service.
2. Instructor Responsibility: Our platform connects you with independent kitesurfing instructors who are responsible for your safety during the lesson or course. The instructors are required to have liability insurance and to follow all safety guidelines and regulations.
3. No Liability: Kite Mavericks takes no responsibility for any accidents, injuries, or damages that may occur during kitesurfing lessons or courses arranged through our platform. We are not liable for any loss or damage of personal property, including but not limited to kitesurfing equipment or any other personal belongings.
4. User Conduct: You agree to use our platform for the sole purpose of connecting with kitesurfing instructors to arrange lessons or courses. You agree not to use our platform for any illegal or fraudulent activities or to harass, abuse, or harm any other users. You agree to keep all business related to Kite Mavericks within the platform and understand there may be ramifications, including a suspended or deleted account, if attempting to conduct business outside of the platform.
5. Fees and Payments: The fees for kitesurfing lessons or courses arranged through our platform are determined by the independent instructors. Kite Mavericks charges a commission fee for each successful booking made through our platform. Payment is due at the time of booking and must be made through our secure payment system.
6. Intellectual Property: All content on our platform, including but not limited to text, graphics, logos, images, and software, is the property of Kite Mavericks or its licensors and is protected by copyright, trademark, and other intellectual property laws. You agree not to use or reproduce any content on our platform without our prior written consent.
7. Indemnification: You agree to indemnify and hold Kite Mavericks, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, demands, or damages, including reasonable attorneys
8. Promotion and Advertising: By using our service and agreeing to these terms and conditions, you grant Kite Mavericks the right to use your image, including photographs or videos taken during kitesurfing lessons or courses arranged through our platform, for the purpose of promotion and advertising of our service. This includes, but is not limited to, use on our website, social media accounts, and marketing materials. You acknowledge that such use of your image will not entitle you to any compensation or royalties.
Cancellation Policy:
1. A full refund will be provided for cancellations made within 48 hours of booking a lesson or course, as well as For lessons cancelled more than 21 days prior to the scheduled lesson or course.
2. A 50% refund will be provided for cancellations made up to between 7 days and 21 days prior to the scheduled lesson or course.
3. No refund will be provided for cancellations made within 7 days or less prior to the scheduled lesson or course.
4. Lessons or courses can be rescheduled at any time for free, as long as both the student and the instructor agree to the new date and time.
5. To cancel a lesson or course, please contact the instructor directly or use the cancellation feature on our platform. Please note that refunds may take up to 7 business days to process.
6. A full refund will be provided if the instructor cancels the lesson at any time.
Payment and Release Policy:
1. Payment for lessons or courses must be made in full before the lesson or course commences.
2. The payment will be held securely by Kite Mavericks for at least 48 hours after the lesson or course is completed.
3. After the 48-hour period has elapsed, the payment will be released to the instructor.
4. If the instructor does not attend the lesson or course for any reason or conditions are unfavourable, the student has 48 hours from the scheduled lesson or course time to request a refund of the payment. If The refund will be processed within 7 business days.
5. If the instructor cancels the lesson or course for any reason, the payment will be refunded to the student within 7 business days.
6. In the event of a dispute between the student and instructor, Kite Mavericks may hold the payment until the dispute is resolved to the satisfaction of both parties.
7. Kite Mavericks reserves the right to charge a fee for processing refunds or resolving disputes.
